18. EXTRACT FROM THE LAW ON THE PROVISION OF DIGITAL CONTENT AND DIGITAL SERVICES AND ON THE SALE OF GOODS:
Regardless of the declared commercial guarantee and the terms thereof, the seller is liable for the lack of non-conformity of the goods with the sales contract. In the event of non-conformity of the goods, the consumer has legal remedies against the seller, which are not related to costs for him, according to Section III "Remedies for consumer protection. Right of recourse" of the Law on the Provision of Digital Content and Digital Services and on the Sale of Goods (ZPCSCUPS). The commercial guarantee does not affect these legal remedies of a consumer.
Information for the consumer from ZPCSCUPS:
Art. 33. (1) When the goods do not meet the individual requirements for conformity with the contract, the objective requirements for conformity and the requirements for assembly or installation of the goods, the consumer has the right:
to file a complaint by requesting the seller to bring the goods into conformity;
to receive a proportionate reduction in the price;
to terminate the contract.
(2) In the cases under para. 1, item 1, the consumer may choose between repair or replacement of the goods, unless this proves impossible or would result in disproportionately high costs for the seller, taking into account all the circumstances of the specific case, including:
the value that the goods would have had if there was no lack of conformity;
the significance of the lack of conformity, and
the possibility of providing the consumer with another remedy without significant inconvenience to the consumer.
(3) The seller may refuse to bring the goods into conformity if repair and replacement are impossible or would result in disproportionately high costs for him, taking into account all the circumstances, including those under para. 2, items 1 and 2.
(4) The consumer has the right to a proportionate reduction in the price or to terminate the sales contract in the following cases:
the seller has not repaired or replaced the goods in accordance with Art. 34, para. 1 and 2 or, where applicable, has not carried out repair or replacement pursuant to art. 34, para. 3 and para. 4 or the seller has refused to bring the goods into conformity pursuant to para. 3;
a lack of conformity has occurred despite the steps taken by the seller to bring the goods into conformity; in the case of non-conformity of durable goods and goods containing digital elements, the seller is entitled to make a second attempt to bring the goods into conformity within the guarantee period under art. 31;
the lack of conformity is so serious as to justify an immediate reduction in the price or termination of the sales contract, or
the seller has stated or it is clear from the circumstances that the seller will not bring the goods into conformity within a reasonable time or without significant inconvenience to the consumer.
(5) The consumer shall not be entitled to terminate the contract if the lack of conformity is minor. The burden of proof as to whether the lack of conformity is insignificant shall be borne by the seller.
(6) The consumer shall have the right to refuse payment of the remaining part of the price or of part of the price until the seller has fulfilled his obligations to bring the goods into conformity.
Art. 34. (1) The repair or replacement of the goods shall be carried out free of charge within a reasonable period of time from the consumer's notification of the lack of conformity to the seller and without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which they were required by the consumer.
(2) For goods other than goods containing digital elements, the repair or replacement of the goods shall be carried out free of charge within one month of the consumer notifying the seller of the lack of conformity and without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which the consumer needed them.
(3) Where the lack of conformity is remedied by repair or replacement of the goods, the consumer shall make the goods available to the seller. In the event of replacement of the goods, the seller shall take back the replaced goods from the consumer at his own expense.
(4) Where the repair requires the dismantling of the goods which were installed in accordance with their nature and purpose before the lack of conformity arose, or where such goods have to be replaced, the seller's obligation to repair or replace the goods shall include the dismantling of the goods which do not conform and the installation of the replacement goods or the repaired goods, or the bearing of the costs of dismantling and installing the goods.
(5) The consumer shall not be liable for payment for the normal use of the replaced goods for the period prior to their replacement.
Art. 35. The price reduction shall be proportional to the difference between the value of the goods received by the consumer and the value that the goods would have had if there had been no lack of conformity.
Art. 36. (1) The consumer shall exercise his right to terminate the contract by means of a statement to the seller informing him of his decision to terminate the sales contract.
(2) Where the lack of conformity concerns only some of the goods delivered under the sales contract and there is a ground for termination of the contract under Art. 33, the consumer shall be entitled to terminate the sales contract only in respect of those goods which do not conform, as well as in respect of any other goods which he has acquired together with the goods which do not conform, if it cannot reasonably be expected that the consumer will agree to keep only the goods which do conform.
(3) Where the consumer cancels the sales contract in whole or in part only in respect of some of the goods delivered under the sales contract, the consumer shall return those goods to the seller without undue delay and not later than 14 days from the date on which the consumer notified the seller of his decision to cancel the sales contract. The deadline shall be deemed to have been met if the consumer has returned or sent the goods back to the seller before the expiry of the 14-day period. All costs of returning the goods, including shipping of the goods, shall be borne by the seller.
(4) The Seller shall refund the consumer the price paid for the goods upon receipt or upon presentation of proof by the consumer of their sending to the Seller. The Seller shall be obliged to refund the amounts received using the same means of payment used by the consumer in the initial transaction, unless the consumer has expressly agreed to use another means of payment and provided that this does not involve any costs for the consumer.
For legal norms not mentioned above, the provisions of the ZZP and ZPCSCUPS shall apply.

7. Alternative Dispute Resolution /ADR/:
Alternative dispute resolution /ADR/ between consumers and traders is an out-of-court conciliation procedure on a voluntary basis. It is carried out through conciliation committees. As a consumer, you have two options:
1. To use the European Online Dispute Resolution (ODR) platform / http://ec.europa.eu / - a single access portal that allows consumers and traders in the EU to settle their disputes related to cross-border online purchases, as well as national ones.
2. To submit an application for mediation directly to the CPC.
The general conciliation committees assist in reaching an agreement between consumers and traders in disputes regarding contracts for the sale of goods and the provision of services, including in relation to warranty liability, the right to claim for goods or services, unfair contract terms, unfair commercial practices, the provision of essential information, tourist services and contracts concluded with consumers. The general conciliation commissions are designated on a regional basis, so that consumers in the country have easy access to them.
As traders, we fall within the area of the general Conciliation Commission for Payment Disputes at the Consumer Protection Commission with the address:
1000 Sofia
1 Vrabcha St., 4th floor
tel.: +359 2 9330565, 0700 11 122
website: www.kzp.bg
e-mail: info@kzp.bg
The conciliation proceedings are free of charge for the parties and they do not pay a fee for considering the dispute.
The language in which consumers submit their complaints and in which the conciliation proceedings are conducted is Bulgarian.
